Nestie Terms of Service
Effective date: September 10, 2026 Who we are: Formenos Group LLC ("Formenos," "we," "us"), the company that operates the Nestie app and service ("Nestie" or the "Service"). Contact: support@nestie-home.com
These Terms of Service ("Terms") are a contract between you and Formenos Group LLC. They govern your use of the Nestie app and website. By creating an account, tapping "I agree" when you first sign in, or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
The short version, in plain language: Nestie gives you general home-maintenance information — it is not professional advice, and you are responsible for your own safety and your own home. Hire licensed professionals for dangerous work. We provide the Service as-is, our liability is capped, and disputes are resolved by individual arbitration rather than lawsuits. The sections below make that legally precise.
1. The Service
Nestie is a home-management app: personalized maintenance checklists, renovation project tracking, document storage, weather-based preparation suggestions, and a concierge that can introduce you to independent home-service professionals. The Service is intended for residents of the United States who are 18 years of age or older.
2. Your account
- You sign in with an email address. Keep it accurate and keep access to it secure — anyone who controls your email can access your account.
- You are responsible for activity under your account.
- One person per account. You may manage multiple homes under one account.
- We may suspend or terminate accounts that violate these Terms (see §11).
3. IMPORTANT — Safety, no professional advice, and assumption of risk
READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
(a) Informational only. All content in the Service — maintenance tasks, checklists, schedules, how-to guidance, cost estimates, weather preparation suggestions, and any other content — is general information, not professional advice. It is not tailored to the specific condition of your home, and it is not a substitute for the judgment of a licensed contractor, plumber, electrician, HVAC technician, structural engineer, inspector, or other qualified professional.
(b) Hire licensed professionals for hazardous work. Some home maintenance involves real danger: gas appliances and gas lines, electrical panels and wiring, structural work, roof work, work at height, water heaters, and hazardous chemicals can cause serious injury, death, or property damage. You agree that work of this kind should be performed by licensed professionals, and that any decision to perform it yourself is your decision alone.
(c) Assumption of risk. You assume all risk arising from your decision to perform, or not perform, any maintenance or repair activity, whether or not the Service suggested it. You are responsible for evaluating whether a task is safe and appropriate for you and your home, for using proper tools and protective equipment, and for complying with local building codes and permit requirements.
(d) No guarantee of completeness. Maintenance suggestions are generated from general information about homes like yours (region, age, features). We do not inspect your home. The Service may suggest tasks your home doesn't need and may omit tasks your home does need. Completing every task in the app does not guarantee your home is safe, code-compliant, or well-maintained.
(e) Emergencies. The Service is not an emergency service. If you smell gas, see sparking, suspect carbon monoxide, or face any emergency, leave the area if appropriate and call 911 or your utility's emergency line — not an app.
4. Weather information
Weather-related suggestions and alerts in the Service are best-effort preparation information derived from third-party sources (including the U.S. National Weather Service). We do not guarantee their delivery, timeliness, accuracy, or completeness — a notification can be delayed, wrong, or never arrive. The Service is not an emergency-alert service and must not be relied on for warnings about dangerous weather. Rely on official channels — Wireless Emergency Alerts, NOAA Weather Radio, and local authorities — for severe-weather warnings.
5. Concierge and third-party professionals
The concierge feature can introduce you to independent home-service professionals (contractors, designers, handymen, realtors, and similar). You agree that:
- Professionals are independent third parties, not Formenos. We do not employ them, supervise their work, or guarantee their licensing, insurance, quality, pricing, or conduct. An introduction is not an endorsement or a recommendation that they are fit for your particular job.
- Your contract is with the professional. Any work you hire them for is between you and them. Any dispute about their work — including workmanship, damage, injury, billing, or conduct — is between you and the professional, and you agree not to hold Formenos responsible for it.
- Vet them yourself. Verify licensing and insurance, get written estimates, and check references before hiring anyone.
- When you submit a concierge request, we share your request details and contact information with the matched professional, as described in the Privacy Policy.
5a. Concierge guidance
Sometimes the concierge answers your question directly instead of (or before) introducing you to a professional. When it does, you agree that:
- Concierge responses are general educational guidance only. They are provided for information, like the rest of the Service's content, and no professional, contractor-client, advisory, or fiduciary relationship is formed between you and Formenos or anyone answering on our behalf.
- We answer based only on what you tell us. Responses rely solely on the information and photos you provide. We do not inspect your home, and conditions we can't see — inside a wall, under a floor, behind a panel — can change the right answer entirely.
- Concierge responses are not licensed-trade advice. They are not a substitute for a licensed contractor, plumber, electrician, HVAC technician, structural engineer, or inspector. Work that requires a license or permit should be evaluated and performed by a licensed professional.
- Codes and permits are local and are your responsibility. Building codes, permit requirements, and licensing rules vary by state, county, and city, and complying with the ones that apply to your home is up to you.
- §3 applies in full to Concierge responses — including its assumption of risk — and any dispute relating to a Concierge response is subject to §15 (arbitration).
6. Subscriptions, billing, and refunds
Nestie is a paid subscription service. Current pricing is shown at the point of purchase — in the App Store for the iOS app, or on our website for web purchases — before you buy.
- Two ways to subscribe, one subscription. You can subscribe in the iOS app (billed by Apple through your Apple account, under Apple's payment terms) or on our website (billed by Stripe, our payment processor). Either way, the subscription unlocks the same Service on all your devices. We never receive or store your payment card details — Apple and Stripe process payment directly.
- Free trial. If a free trial is offered, you provide a payment method up front and the trial converts automatically to a paid subscription at the end of the trial period unless you cancel before it ends.
- Auto-renewal. Subscriptions renew automatically each billing period until you cancel. For Apple-billed subscriptions, cancel at least 24 hours before the end of the current period to avoid the next charge.
- Cancellation. Apple-billed subscriptions: cancel in your device's subscription settings (Settings → Apple Account → Subscriptions). Web (Stripe-billed) subscriptions: cancel from the billing section of your account or by emailing support@nestie-home.com. Cancellation stops future renewals; you keep access through the end of the period you've paid for, and it does not refund the current period.
- Refunds — Apple purchases. Purchases made through Apple are refunded (or not) by Apple under Apple's refund policy — request one at reportaproblem.apple.com. We cannot issue refunds for purchases Apple billed.
- Refunds — web purchases. For subscriptions billed by Stripe, charges are generally non-refundable and we do not provide refunds or credits for partial subscription periods, except where required by law. If you believe you were charged in error, email support@nestie-home.com and we'll take a look.
- Price changes. If we change subscription pricing, the change applies at your next renewal, with advance notice as required by Apple, Stripe, and applicable law.
- Free access. If any part of the Service is offered free (for example, a beta, trial, or promotional period), these Terms still apply to it, and we may change or end free access at any time.
7. Your content
You keep ownership of everything you put into the Service — photos, documents, receipts, notes, project details, and task history ("Your Content"). You grant us a limited license to host, store, back up, display, and transmit Your Content solely to operate the Service for you. We don't read, analyze, sell, or advertise against Your Content.
You are responsible for Your Content — including having permission to store other people's contact details (for example, contractors you add to a project) and not uploading content that is illegal or infringes anyone's rights.
8. Acceptable use
You agree not to:
- use the Service for anything unlawful, or upload content you have no right to upload;
- probe, scan, or test the vulnerability of the Service, bypass authentication or rate limits, or access other users' data;
- scrape, harvest, or bulk-extract content or data from the Service;
- reverse engineer, copy, resell, or build a competing product from the Service or its content;
- use the Service to spam, harass, or defraud anyone (including professionals introduced through the concierge);
- interfere with the operation of the Service or impose an unreasonable load on it.
9. Intellectual property
The Service — including its software, design, task content, and branding — belongs to Formenos Group LLC or its licensors and is protected by intellectual-property law. We grant you a personal, limited, non-exclusive, non-transferable license to use the app for managing your own home(s) while these Terms are in effect. No other rights are granted.
9a. Copyright complaints (DMCA)
We respect copyright and expect users to do the same. If you believe content stored in the Service infringes your copyright, you can send a notice under the Digital Millennium Copyright Act (DMCA) to our designated agent:
DMCA Agent, Formenos Group LLC — email support@nestie-home.com (subject line "DMCA notice"). Our designated agent is also listed in the U.S. Copyright Office's DMCA Designated Agent Directory (dmca.copyright.gov), including a mailing address for written notices.
A valid notice must include:
- Identification of the copyrighted work you claim is infringed;
- Identification of the material you claim is infringing, with enough information for us to locate it;
- Your name, mailing address, telephone number, and email address;
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner; and
- Your physical or electronic signature.
What we do. On receiving a valid notice, we will remove or disable access to the identified material and make a reasonable attempt to notify the user who stored it.
Counter-notice. If your material was removed and you believe that was a mistake or misidentification, you may send our agent a counter-notice containing: identification of the removed material and where it appeared; your name, address, phone number, and email; a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, any judicial district in which we may be found) and will accept service of process from the person who filed the original notice; and your physical or electronic signature. Unless the original complainant tells us within 10 business days that they have filed a court action, we may restore the material in 10–14 business days.
Repeat infringers. We will terminate the accounts of users who are repeat infringers in appropriate circumstances.
10. Third-party services
The Service is built on third-party infrastructure and data sources (hosting, email delivery, push notification delivery, government weather data). We are not responsible for outages or errors in third-party services, though we work to handle them gracefully.
11. Termination
- By you: delete your account in the app at any time (Settings → Danger zone). Deletion is permanent.
- By us: we may suspend or terminate your access if you materially violate these Terms, if required by law, or if we discontinue the Service. If we discontinue the Service entirely, we will give reasonable advance notice so you can export what you need.
- Sections that by their nature should survive termination (including §3, §5, §5a, and §12–§16) survive.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED — INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT ANY CONTENT (INCLUDING MAINTENANCE GUIDANCE AND WEATHER INFORMATION) IS ACCURATE, COMPLETE, OR SUITABLE FOR YOUR HOME; OR THAT ANY PROFESSIONAL INTRODUCED THROUGH THE SERVICE IS QUALIFIED OR WILL PERFORM ADEQUATELY. Some states do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) FORMENOS GROUP LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, PROPERTY DAMAGE, OR PERSONAL INJURY, ARISING FROM OR RELATING TO THE SERVICE — INCLUDING FROM MAINTENANCE GUIDANCE, WEATHER INFORMATION, ADVICE, GUIDANCE, OR CONCIERGE COMMUNICATIONS OF ANY KIND, OR PROFESSIONALS INTRODUCED THROUGH THE SERVICE — EVEN IF WE HAVE BEEN ADVISED SUCH DAMAGES ARE POSSIBLE; AND (b) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS CAPPED AT THE GREATER OF (i) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (ii) FIFTY U.S. DOLLARS ($50).
Some states do not allow certain limitations of liability, so parts of this section may not apply to you. In those states, our liability is limited to the fullest extent permitted by law. The limitations in this section are fundamental to the bargain between you and us — the Service's pricing reflects them.
14. Indemnification
You agree to defend and hold harmless Formenos Group LLC and its officers, members, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from: (a) Your Content; (b) your violation of these Terms; (c) your performance of, or failure to perform, any maintenance or repair activity; or (d) your dealings with any professional introduced through the Service.
15. Dispute resolution — binding arbitration and class-action waiver
READ THIS SECTION CAREFULLY. IT REQUIRES INDIVIDUAL ARBITRATION OF DISPUTES AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS.
(a) Talk to us first. Before filing any claim, you agree to email support@nestie-home.com with a description of the dispute and give us 60 days to try to resolve it informally. Most issues get fixed this way.
(b) Binding arbitration. Any dispute arising out of or relating to these Terms or the Service that we can't resolve informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The Federal Arbitration Act governs this section. The arbitrator's decision is final and enforceable in court. Arbitration will be conducted by videoconference or, if either party requests, in the county where you live; AAA's consumer fee schedule applies, and we will pay filing and arbitrator fees the rules assign to us.
(c) Exceptions. Either party may (i) bring an individual claim in small-claims court instead of arbitrating, and (ii) seek injunctive relief in court for infringement or misuse of intellectual property.
(d) Class-action waiver. All disputes must be brought in the parties' individual capacity, not as a plaintiff or class member in any class, consolidated, or representative proceeding, and the arbitrator may not consolidate claims or preside over any form of representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) must proceed in court, not in class arbitration, and the rest of this section still applies to all other claims.
(e) 30-day opt-out. You may opt out of this arbitration agreement by emailing support@nestie-home.com within 30 days of first accepting these Terms, with your name, account email, and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
16. Governing law
These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-laws rules, except that §15 is governed by the Federal Arbitration Act. For any dispute not subject to arbitration, you and Formenos consent to the exclusive jurisdiction of the state courts of Kansas and the U.S. District Court for the District of Kansas.
17. Apple App Store terms
These terms apply when you use the iOS app, and they follow Apple's required minimum terms for app developers:
- These Terms are between you and Formenos Group LLC only — not Apple. Apple is not responsible for the app or its content.
- Your license to the app is limited to a non-transferable license to use it on Apple-branded devices you own or control, as permitted by the App Store Terms of Service (except that Family Sharing may apply where enabled).
- Formenos, not Apple, is responsible for maintenance and support of the app. Apple has no obligation to provide any support for it.
- If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation, and any other warranty claims are Formenos's responsibility as set out in these Terms.
- Formenos, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that it fails to conform to legal or regulatory requirements, and consumer-protection or similar claims.
- In the event of a third-party claim that the app infringes intellectual-property rights, Formenos, not Apple, is responsible for the investigation, defense, settlement, and discharge of the claim.
- You represent that you are not located in a country subject to a U.S. government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
- Questions or complaints about the app go to support@nestie-home.com.
- You must comply with applicable third-party terms of agreement when using the app (for example, your wireless carrier's data agreement).
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18. Changes to these Terms
We may update these Terms as the Service evolves. For material changes we will notify you in the app or by email before the change takes effect, and update the effective date above. Continuing to use the Service after a change takes effect means you accept the updated Terms. If you don't accept them, stop using the Service and delete your account.
19. Everything else
- Severability: if any provision of these Terms is found unenforceable, the rest remain in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
- No waiver: our not enforcing a provision is not a waiver of it.
- Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of the Service (with notice, per the Privacy Policy).
- Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us about the Service.
